Welcome to Tradility — a software platform and set of digital tools (“Add-ons”) developed and operated by Tradility GmbH (“we”, “us”, or “our”).

By using Tradility, purchasing any add-ons, or activating a trial, you (“the user”, “you”) agree to be bound by these Terms of Service (“Terms”).
Please read them carefully before using our services.

2. Scope of Application

These Terms apply to all digital content, software licenses, subscriptions, and trial products offered through tradility.de or via integrated platforms (including the Shopify App Store and Microsoft Store).

By creating an account, purchasing, or using Tradility, you accept these Terms and our Privacy Policy


3. Description of Service

Tradility provides:

  • a trading and analytics software tool (“Tradility App”);

  • optional digital add-ons (“Modules”, “Extensions”) that enhance functionality;

  • subscription-based or one-time-purchase digital licenses.

All software and digital content are delivered electronically — no physical goods are shipped.


4. License to Use

Upon successful payment or activation of a trial, you are granted a non-exclusive, non-transferable license to install and use the Tradility software and its add-ons for personal or professional use in accordance with these Terms.

You may not:

  • redistribute, resell, or sublicense Tradility or its components;

  • reverse engineer, decompile, or modify the source code;

  • use the software to develop competing products.

All intellectual property rights remain the sole property of Tradility GmbH.


5. Trials and Evaluation Licenses

Some add-ons may be offered with a free trial period of up to 30 days.
During this period, you may test the product without obligation to purchase.

After the trial expires:

  • continued use requires a valid license or active subscription;

  • unlicensed features will be deactivated.

We reserve the right to modify trial durations or eligibility at any time.


6. Subscriptions and Billing

Some services or add-ons are offered as monthly subscriptions.
By subscribing, you agree to recurring billing through our authorized payment processor (e.g., Shopify Payments).

  • Billing Cycle: Monthly, beginning on the purchase or renewal date.

  • Renewal: Subscriptions automatically renew unless cancelled before the next billing date.

  • Cancellation: You may cancel anytime via your account or through the platform (Shopify or in-app account).

Upon cancellation, you retain access until the end of the current billing period.


7. Prices and Payment

All prices are displayed in EUR and include applicable VAT where required.
Payments are processed securely by Shopify or other approved providers.

We do not store credit card data.
Payment confirmation constitutes acceptance of the contract.


8. Right of Withdrawal (EU Consumers)

If you are an EU consumer, you have a statutory right of withdrawal under §§ 355 ff. BGB.

You may withdraw from your purchase within 14 days without giving any reason.
The withdrawal period starts on the day of the contract conclusion (the date of purchase).

Please include your name, order number, and the product concerned.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to digital content that is not supplied on a tangible medium once the download or activation has begun with your prior express consent and acknowledgment that you lose your right of withdrawal once access starts.


9. Refund Policy

Refunds are only possible under the following circumstances:

  • Technical issues prevent activation and cannot be resolved within 7 business days after contacting support;

  • Statutory right of withdrawal applies (see Section 8).

No refunds are granted for:

  • expired trial periods;

  • activated digital content;

  • subscription renewals already processed.


10. Account and Verification

Some functions (license restoration, trial activation, etc.) require an email-verified account.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.


11. Data Protection and Privacy

Our processing of personal data is governed by our Privacy Policy, which complies with the EU General Data Protection Regulation (GDPR).

We collect only necessary data for licensing, analytics, and transaction purposes, handled via secure third-party processors (e.g., Shopify, Firebase, Google Analytics).


12. Updates and Modifications

We may release software updates, security patches, or improvements automatically.
We reserve the right to modify or discontinue features at any time with reasonable notice.


13. Limitation of Liability

To the extent permitted by law:

  • Tradility GmbH shall not be liable for indirect, incidental, or consequential damages, including loss of profit, trading loss, or data loss;

  • Our total liability for direct damages shall not exceed the total fees paid by you in the previous 12 months.

The software is provided “as is,” without warranty of uninterrupted operation or error-free performance.


14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

The competent court of jurisdiction is Düsseldorf, Deutschland, unless mandatory consumer protection laws specify otherwise.


15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
